Terms of Service
Menuvate · Last updated 19 October 2026
These terms are the agreement between your business and Point of Sale Solutions of New England for using Menuvate. We have tried to keep them short and in plain English. Using Menuvate, starting a trial or paying for a plan means you accept them.
1. Who we are
Menuvate is made and run by Point of Sale Solutions of New England, 381 Elliot Street, Ste 140L, Newton, MA 02464 ("we", "us"). "You" means the restaurant or business that uses Menuvate, and the people it lets use its account.
2. What Menuvate does
Menuvate reads your menu, helps you edit, proofread, price and design it, compares it with nearby restaurants' published menus, and estimates food cost and dish profitability. Features marked "coming" in the app or on our site are planned but not yet available; your plan price does not depend on them.
3. The sample restaurant and free trials
- Anyone may look around our sample restaurant. It is invented, read-only, and for demonstration only.
- A free trial on your own menu needs your name, email and phone. We set it up and tell you how long it runs and what it includes. A trial may have lower limits than a paid plan, including on AI features.
- At the end of a trial your account becomes read-only until you choose a plan. If you do not choose one within a year of the trial ending, we may delete the trial account and its contents.
4. Plans, prices and billing
- Plans are priced per location, per month, as shown on our pricing page. Each location includes the allowances listed there (active menus, compared and watched competitors, competitor changes per month). Extras, such as more menus or more watched competitors, are charged as listed.
- You can pay monthly or yearly. Yearly plans are paid in advance and include the discount shown at the time.
- Payments are taken by card through our payment processor, Stripe. We never see or store your full card number. Plans renew automatically at the end of each month or year until cancelled.
- Done-for-you setup is a one-time charge, billed when we start the work.
- Point of Sale Solutions of New England POS clients pay half the plan price for as long as they remain current POS service clients. If that relationship ends, the regular price applies from the next billing date.
- Prices are in US dollars and do not include any sales tax, which is added where it applies.
- We may change prices. We will tell you by email at least 30 days before a change affects you, and it applies from your next renewal after that. If you do not want to continue at the new price, you can cancel before that renewal as described in section 5, and you will not be charged the new price.
- If a payment fails, we will tell you and try again. If it is still unpaid after 14 days, we may make your account read-only until it is.
5. Cancelling and refunds
- You can cancel at any time, from the app or by emailing us. Your plan stays active until the end of the period you have paid for, and does not renew.
- To stop the next renewal, cancel at least 7 days before your renewal date. A cancellation that reaches us later than that takes effect from the following renewal, so the coming month (or year) is still charged.
- We do not refund part-used months. A yearly plan cancelled within its first 30 days is refunded in full, less any setup work already done; after that, it runs to the end of the year.
- Setup charges are not refundable once the work has been delivered.
- After cancellation you can export your menus for 30 days. After that we may delete the account and its contents.
6. Your content
- Your menus, recipes, prices, sales figures, images and files remain yours. You give us permission to store and process them only to run Menuvate for you, as described in our privacy policy.
- You confirm that you have the right to upload what you upload, including photos and logos.
- A menu you choose to share into the shared competitor archive becomes part of the archive for good, unless you withdraw it yourself in the app; it stays even if you delete your own copy or close your account. Only its public parts are shared (dish names, descriptions, prices, price tiers, add-ons and dietary marks), never your food costs, POS details or photos. We may remove anything shared by mistake or that should not be there, and a restaurant listed in the archive can ask us to remove its menu.
7. Estimates, competitor prices and AI results
Menuvate gives you information to help you decide; the decisions are yours. In particular:
- Food-cost, profit and sales figures are estimates built from typical ingredient prices and the numbers you enter. Check them against your own invoices before relying on them.
- Competitor prices come from menus restaurants publish themselves and may be out of date or read incorrectly. Dish matching between menus is automatic and can be wrong; you can mark a match as wrong in the app.
- Proofreading, descriptions, translations and other AI suggestions can contain mistakes. Review every change before you print or publish a menu.
8. Using Menuvate fairly
You agree not to:
- share your account with another business, or resell Menuvate;
- try to reach another customer's data, or get around the limits of your plan;
- use Menuvate to collect anything other than restaurants' publicly published menus, or to overload restaurant websites;
- upload anything unlawful, or that you have no right to use;
- copy, take apart or rebuild Menuvate itself.
AI features have a fair-use allowance per account so that costs stay predictable for everyone. If an account goes far beyond normal use, we will contact you before limiting it.
9. Your access code
Access to a Menuvate account is by an access code. Anyone holding your code can see and change everything in your account, so share it only with people you trust and tell us straight away if you need it changed. You are responsible for what is done with your code until you tell us.
10. Availability and changes to Menuvate
We work to keep Menuvate running and your data backed up, but we cannot promise it will never be interrupted. We improve Menuvate often; we may change or remove features, and if we remove something central to your plan we will tell you in advance and you may cancel; on a yearly plan we will refund the whole months left.
11. Limits of our responsibility
- Menuvate is provided as it is. As far as the law allows, we do not promise that it will meet every need, be error-free, or that following its suggestions will increase your sales or profit.
- As far as the law allows, we are not responsible for lost profits, lost sales or indirect losses, and our total responsibility for any claim about Menuvate is limited to what you paid us for Menuvate in the 12 months before the claim.
- Nothing in these terms limits a responsibility that the law does not allow to be limited.
12. Ending the agreement
You can end it by cancelling (section 5). We may suspend or close an account that breaks these terms or goes unpaid; except in serious cases, we will tell you first and give you a chance to put it right, and you will have 30 days to export your menus.
13. Law
These terms are governed by the laws of the Commonwealth of Massachusetts. Any dispute will be handled in the courts of Massachusetts, though we would always rather settle it by talking first.
14. Changes to these terms
If we change these terms, the new version appears here with a new date. We will tell you by email or in the app at least 30 days before a change that materially affects you. Continuing to use Menuvate after that means you accept the change.
